Legal protection against discrimination for intersexs in Serbia

Serbian Anti-Discrimination Law has changed, it now also protects intersexs. 

With the amendment to the Anti-Discrimination Law in Serbia, gender characteristics covering intersex are now recognized by law as a basis for discrimination. With this amendment to the law, Serbia became the second country in the region to legally recognize discrimination against intersexs. 

Kristian Randjelovic, director of the intersex organization XY Spectrum, expressed satisfaction with this development: 

“Recognition of intersex people by law will ensure that intersex people's bodily integrity and autonomy are protected. We particularly welcome the amendment to article 22, paragraph 2 of the Law on the Prohibition of Discrimination, which recognizes the gender characteristics of children as a possible basis for discrimination, and we believe that these amendments will allow for the establishment of appropriate regulations to regulate the developmental situation of intersex children.”

Psychiatrist Dr. Katarina Maksimović says, “If specialists think medical intervention is necessary, parents should be informed about the risks and possible consequences of this intervention, and if the operation is not vital, these operations should be postponed for the best outcome for intersex children.”
